This agreement is designed to educate the Client fully with regard to what to expect in his or her upcoming photography session with Chelsea Mazur Photography.
SESSION
1) Creative Fees: Creative fees are non-refundable and must be paid in full within 7 business days of booking your session. The creative fee covers time and talent to produce your artwork, the full studio or on-location shoot and online gallery of images.
2) Artistic Style: Client acknowledges that he or she is familiar with the Photographer’s portfolio and is requesting services with knowledge of the Photographer’s style; that Photographer’s work is unique and of an artistic nature; that the photographs may be different from work Photographer has done in the past; and in creating the photographs, Photographer shall use her personal and artistic judgment to create images consistent with her vision for the shoot. Accordingly, Client acknowledges that the photographs may not be subject to rejection on the basis of artistic or aesthetic criteria.
4) The Client is responsible for additional fees and costs related to location choice including but not limited to admission fees, parking and location-specific photography permits. Travel within 30 miles of 40207 round-trip is included. Time and travel above this will be invoiced at $2/mile.
5) Other cameras are not allowed at any photography session.
6) Dates cannot be held without a full session payment.
RESCHEDULING AND RESHOOTS
7) Requests for rescheduling are granted only at the discretion of the Photographer. If client shall become ill and unable to attend their session, Client shall notify Photographer as soon as possible. Reasonable efforts will be made to accommodate rescheduling requests under these circumstances, but they are not guaranteed. After a second request to reschedule or if the session does not take place within 60 days of the original shoot date, client forfeits session fee and regular prices apply to the rescheduled session. Photographer retains the right to reschedule for illness, inclement weather, emergency or the like.
8) No-shows or extreme tardiness: If Client fails to show up for his or her session or are an hour or more late, the Session Fee will be forfeited. If Client wishes to reschedule his or her session after this, regular Session Fees will apply.
PROOFING AND ORDERING
9) Within 3 weeks of the session, Photographer will complete the session edits and notify Client with how to access their online gallery. Peak busy season might result in a delay in the delivery of images.
10) Retouching of images is included in the Session Fee. All images in the client gallery are retouched at Photographer’s discretion, according to her artistic vision. Any additional retouching requests or changes, beyond the Photographer’s edits, are billed at $35 p/hour. Photographer reserves the right to deny retouching requests that are not in line with her artistic style or vision.
11) Photographer will provide printing instructions, upon request. Client shall not crop, color or otherwise alter the final images. Photographer is not responsible for printing errors or quality of prints not produced directly by her photography lab.
COPYRIGHT
12) Photographer retains full copyrights to all images and artwork produced in Client’s session. Photographer retains the right to use the images for display, publication, marketing, social media or other purposes at her discretion. Under no circumstances can a client use the images for commercial purposes, such as selling the images for profit or submitting the images to a photographic competition.
13) Credits and special offers are non-transferrable and not redeemable for cash.
MODEL RELEASE
All photographs taken or presented by Photographer may be used by Chelsea Mazur Photography and its agents, for the purpose of display, portfolio, advertising, website, social media or publication without notification or compensation to the Client.
Client’s booking of and subsequent participation in his or her photo shoot serves as an acknowledgment that he or she has read and understands all of the provisions and agreements herein.
